The service
CultureLens Circles is provided by IV Talent to teams and the organisations they belong to. Where a written agreement is in place with an organisation, that agreement takes precedence over these terms for the people covered by it.
Accounts and access
Accounts are personal. Sign in details should not be shared, and access is granted only after approval. Signing in confirms agreement to coaching conversations being recorded and processed so the coaching can continue between sessions. Access can be suspended or removed if an account is misused, if someone leaves the team, or if the organisation ends its use of the service.
Confidentiality
Private coaching content belongs to the person it came from. No attempt should be made to obtain, reconstruct or infer another person's private content, whether through the tool, through shared patterns, or by any other means. Material shared into the team layer is intended for that team and should be treated as confidential to it. IV Talent treats customer content as confidential and uses it only to run and support the service.
Acceptable use
- Use the tool for team coaching and collaboration, not for surveillance of people.
- Do not use it to make decisions about someone's employment on the basis of private coaching content.
- Do not upload content you do not have the right to share.
- Keep information about health, personal circumstances and legal matters out of the tool.
- Do not attempt to probe, bypass or overload the service, or to extract information you are not entitled to see.
Your content
Content added to the tool remains yours or your organisation's. IV Talent is granted only the permission needed to store it, process it and show it to the people entitled to see it. Content is not sold and is not used to train third party models.
Automated support
Part of the service uses speech and language processing to run the coaching conversation and to summarise patterns. It can be wrong or incomplete. Nothing it produces is advice of a professional, legal, medical or financial kind, and it should not be relied on as the sole basis for a decision about a person.
Availability and limits
The service is provided with reasonable care and skill, but it is not guaranteed to be uninterrupted or error free, and features can change. Except where liability cannot be limited by law, IV Talent is not liable for indirect or consequential loss, or for loss of profit, revenue or anticipated savings.
Ending use
An organisation can stop using the service at any time, and an individual can ask for their account to be closed. When a coaching assignment ends, the records belonging to it are deleted within the periods set out in the privacy notice. There should be no expectation that anything is kept beyond the assignment.
Governing law
IV Talent is headquartered in South Carolina, and these terms are governed by the laws of the State of South Carolina, unless a written agreement says otherwise. Where a client or its people are in the UK or the European Economic Area, nothing in these terms limits the protections those people have under applicable data protection law.
